Heirship indicators when there’s no probate

When a former owner has died but no probate was opened, claiming surplus funds becomes a question of documenting heirship through other means. In many states, an affidavit of heirship signed by disinterested witnesses can establish heirship for some purposes.

Halos Over Houses does not draft heirship affidavits. We document the indicators in the public record — death certificates where publicly available, obituaries, prior deed history, and family connections that show up in property records — and surface them to the reviewing attorney.
