How to call your county and ask about surplus funds

A short, practical guide. You can do this for free.

Find the right office first. For mortgage foreclosure surplus, start with the county clerk or district clerk. For tax-sale overage, start with the county tax assessor or tax office.

Have ready: the property address, the approximate year of sale, and — if you have it — the case number.

Ask three questions: (1) Is there surplus held under this property? (2) What is the filing process to claim it? (3) Is an attorney required to file?

Take notes. Ask for a written copy of the process if it exists. If you decide to hire help afterward, you’ll have a baseline.
